PROTECTED SPECIES ACT 2002

 by the Parliament of the Republic of Fiji—

Short title and commencement

1.—(1)  This Act may be cited as the Endangered and Protected Species (Amendment) 

Act 2016.

(2)  This Act comes into force on the date of its publication in the Gazette.

(3)  In this Act, the Endangered and Protected Species Act 2002 is referred to as the 

“Principal Act”.

Section 31 amended

2.  Section 31 of the Principal Act is amended by—

(a)  renumbering section “31” as section “31.—(1)”;

(b)  in subsection (1), inserting “of” after “purposes”; and

(c)  inserting the following new subsection after subsection (1)—

 

  “(2)  The Secretariat shall provide a guideline to regulate the utilisation 



of the trust fund.”

Deletion of “Islands”

3.  The Principal Act is amended by—

(a)  deleting “Islands” after “Fiji” wherever it appears; and

(b)  in sections 6, 7(4)(e), 8(2)(c), 13(3)(c) and 20(1)(a), deleting “the” before 

“Fiji” wherever it appears.



Schedule 1 amended

4.  Schedule 1 to the Principal Act is amended by—

(a)  in Part 1, inserting—

ENDANGERED AND PROTECTED SPECIES (AMENDMENT) BILL 2016

EXPLANATORY NOTE

(This note is not part of the Bill and is only intended to indicate its general effect)

1.0 BACKGROUND 

1.1 


The Endangered and Protected Species Act 2002 (‘Act’) is the governing law that 

regulates the international trade, domestic trade, possession and transportation 

of species protected under the Convention on International Trade of Endangered 

Species and Wild Fauna and Flora (‘CITES’).

1.2 

Based on analysis made by the Fiji CITES Management Authority (‘Authority’



and the Fiji CITES Scientific Council (‘Council’), there is a need to review the 

species listing so as to include other species that need protection under the Act.

1.3 

Accordingly, this Bill seeks to amend the Act to include such species.



2.0 CLAUSES 

2.1 


Clause 1 of the Bill provides for the short title and commencement provision. 

2.2 


Clause 2 of the Bill amends section 31 of the Act by including a new subsection 

for the setting up of a guideline by the Secretariat of the Authority or the Council, 

for the utilisation of trust funds.

2.3 


Clause 3 of the Bill amends the Act to give clarity to references to “Fiji” and 

not “Fiji Islands” throughout the Act. 

2.4 

Clause 4 of the Bill amends Schedule 1 to the Act by inserting the names of 



species which are endemic to Fiji and are threatened with extinction but which 

are not listed in Appendix 1 of CITES. 

2.5 

Clause 5 of the Bill amends Schedule 2 to the Act by inserting the names of 



species which are endemic to Fiji but are not listed in any appendix of  CITES 

or Schedule 1 to the Act.

3.0 

MINISTERIAL RESPONSIBILTY

3.1  


The Act comes under the responsibility of the minister responsible for 

environment.
