MINISTERIAL ORDER Nº005/2008 OF 15/08/2008 ESTABLISHING MODALITIES OF INSPECTING COMPANIES OR ACTIVITIES THAT POLLUTE THE ENVIRONMENT The Minister of Natural Resources; Pursuant to the Constitution of the Republic of Rwanda of 4 June 2003 as amended to date, especially in Articles 49,120, 121, and 201 Given the Organic Law nº 04/2005 of April 8, 2005 determining the modalities of protection, conservation and promotion of the environment in Rwanda especially in its Article 79; After consideration and approval by the Cabinet in its session of 14/11/2007; ORDERS:

CHAPTER ONE: GENERAL PROVISIONS Article One: Scope This Order determines the modalities of inspecting companies or activities that pollute the environment.	CHAPITRE PREMIER : DISPOSITIONS GENERALES Article premier : Objet du présent arrêté Le présent arrêté détermine les modalités d’inspection des entreprises ou des activités source de pollution de l’environnement.

Ingingo ya 2: Abashinzwe gukora igenzura Hatabangamiwe amategeko n’amabwiriza yo kugenza ibyaha, abafite ububasha bwo kugenza ibyaha mu bijyanye n’ibidukikije bakora igenzura rijyanye no kurengera ibidukikije bakurikije uburyo buvugwa mu ngingo zikurikira.	CHAPTER II: INSPECTION OF COMPANIES OR ACTIVITIES THAT POLLUTE THE ENVIRONMENT. Article 2: Inspectors Without prejudice to laws and regulations governing criminal investigations, officers competent to investigate environmental crimes shall conduct an inspection aimed at protecting the environment as provided for in the following Articles.	CHAPITRE II : INSPECTION DES ENTREPRISES OU ACTIVITES SOURCES DE POLLUTION DE L’ENVIRONNEMENT Article 2: Les inspecteurs Sans préjudice des lois et règlements portant instruction criminelle, les officiers compétents pour mener des enquêtes en matière d’environnement effectuent des investigations selon les modalités indiquées dans les articles qui suivent.

Ingingo ya 3: Gusaka Abakozi babifitiye ububasha bavugwa mu ngingo ya 2 y’iri teka, bashobora kwinjira ahantu aho ariho hose bagasaka ahakekwa kuba hakorerwa ibikorwa byangiza cyangwa bibangamira ibidukikije. Iyo abakozi babifitiye ububasha babona ko bashobora guhohoterwa n’abo bagiye gusaka, biyambaza ubuyobozi bwa polisi buri hafi cyangwa se ubuyobozi bw’inzego z’ibanze. Abakozi babifitiye ububasha, bashobora kandi no kujya ahandi hose imishinga ikorera kureba uburyo bubahiriza kubungabunga no kurengera ibidukikije n’ubwo aho hantu haba hadakekwa. Mu gihe cy’igenzura risanzwe, ugenzurwa abimenyeshwa amasaha mirongo ine n’umunani (48) mbere y’igenzura kandi iryo genzura rigakorwa ugenzurwa ahari cyangwa undi wese yabihereye uburenganzira.

Article 3: Searching The competent officers mentioned in Article 2, may enter and carry out a search in any place suspected to be carrying out activities which pollute the environment. When the Officers figure out that they might be harmed by the person under search, the nearest police station or local authority shall be called upon to assist in the process. The competent Officers can conduct inspection in companies or activities to make sure the environment is conserved and protected, even when the companies or activities are not suspected. In case of routine inspection, the person to be inspected shall be informed forty eight (48) hours prior to the inspection and it is carried out in his/her presence or in the presence of a person he/she has delegated.

Article 3 : Perquisition Les Officiers compétents mentionnés à l’article 2, peuvent entrer dans n’importe quel endroit où l’on suspecte des activités nuisibles à l’environnement et Y effectuer des perquisitions. Lorsque les Officiers se rendent comptent qu’ils risquent de subir des agressions de la part des gens qui font l’objet de perquisition, ils font recours à l’assistance de la Station de police ou des autorités de base les plus proches. Les Officiers compétents peuvent également mener des inspections auprès des entreprises ou activités en vue de s’assurer que l’environnement est bien conservé et protégé, quand bien même ledit endroit ne serait pas suspecté. Toute inspection de routine s’effectue en présence de la personne concernée ou son délégué, qui doit être avisée quarante huit (48) heures avant.
