Article 26. Sales of tourism product
The sale of a tourist product is carried out on the basis of an agreement concluded between a tour operator and / or a travel agent and a customer of a tourist product.
The customer of a tourist product is a tourist, a sightseer or another person ordering a tourist product on behalf of a tourist or sightseer.
The agreement between the travel agent and the tour operator must contain:
conditions for the sale of a tourist product by a travel agent;
rights and obligations of a travel agent for the sale of a tourist product on behalf of a tour operator or on its own behalf;
conditions providing for the possibility (impossibility) of the conclusion by the travel agent of subagent agreements;
the procedure for the interaction of the tour operator and travel agent in the event that the customer submits a tourist product claims for the execution of the contract for the provision of tourist services;
the responsibility of the tour operator and travel agent, as well as the responsibility of each of the parties to the customer of the tourist product for failure to provide or provide false information about the tourist product, for non-fulfillment or improper performance of obligations under the contract for the provision of tourist services.
The agreement between the tour operator and (or) the travel agent and the customer of the tourism product must contain:
name of the tour operator and (or) travel agent, its location (mailing address), direction and license number;
information about the customer of the tourism product in the amount necessary for the sale of the tourism product;
the cost of the tourist product and the procedure for its payment;
rights and obligations of the tour operator and (or) travel agent and customer of the tourism product;
terms of amendment and termination of the contract;
responsibility of the tour operator and (or) travel agent and customer of the tourism product and the procedure for resolving disputes.
The tour operator and / or travel agent and the customer of the tourist product may agree in the contract the conditions of consumption of the tourist product, including the travel program, route and travel conditions, information on accommodation facilities, accommodation and meals, transportation services for tourists and sightseers in the country (place) temporary residence, availability of a guide, guide (guide-translator), instructor-guide, as well as additional services.
The agreement between the tour operator and / or travel agent and the customer of the tourism product may contain other conditions.
Guides, guides (guide-translators) and instructors-guides can provide their services without concluding a contract.
