THE ROLE OF CUSTOMS AUTHORITIES IN THE LEGAL PROTECTION OF 
INTELLECTUAL PROPERTY OBJECTS

Summary:
This article analyzes the issues of protection of intellectual property objects by 
customs authorities. In order to increase the effectiveness of the Customs service of the Republic of 
Uzbekistan in combating counterfeit products, proposals and recommendations have been made to 
improve the mechanism of interaction between copyright holders and customs authorities in the 
implementation of customs control of goods containing intellectual property objects.

INTRODUCTION. 
Deepening the processes of economic integration, increasing the volume of international 
trade create a problem of trade turnover with signs of violation of intellectual property rights, in 
other words, counterfeit products. The turnover of counterfeit goods in the world is about 1.3 
trillion rubles. the dollar, that is, more than 3% of all world trade. 
Violations in the field of intellectual property cause enormous damage not only directly to 
the copyright holder and consumers of products, but also to the interests of the state as a whole, 
threatening its economic and national security. In this regard, it is important to ensure the 
administrative and legal protection of intellectual property by the state. 
Customs authorities play a special role in the implementation of the planned direction of 
intellectual property protection. Occupying one of the leading positions in the system of customs 
administration, they have great powers to apply administrative measures against persons who have 
committed offenses in the field of intellectual property. Customs authorities prevent, detect and 
suspend administrative offenses related to the illegal use of intellectual property rights when 
moving goods across the customs border, carry out proceedings on such categories of cases, thereby 
preventing the penetration of mainly counterfeit goods into the domestic market. 
It marked the beginning of the activities of the customs authorities of our country within the 
framework of the Eurasian Economic Union, including a new stage of customs regulation in the 
field of intellectual property protection. Currently, the customs legislation is being updated, new 
directions for the development of customs authorities are being approved, which entails a 
corresponding change in their functions and tasks.
Procedural difficulties, problematic issues arising in the activities of customs authorities for 
the protection of intellectual property rights and at the same time their special importance for 
ensuring the economic and national security of our country require scientific disclosure of 
theoretical and practical aspects of the established activities of customs authorities. In order to 
increase the effectiveness of the fight against illegal trafficking of intellectual property objects, as in 
our country, it is necessary to clarify scientific and conceptual concepts, develop appropriate 
theoretical provisions for the formation of scientific recommendations for improving the legal 
activities of customs authorities in the field of intellectual property rights protection.
