the regulatory framework is being improved, state programs aimed at the development of the
information society are being adopted.
The project "information security policy" of our country [7.] the state program deserves
attention. Achieving such a level of development of information protection technologies that ensure
confidentiality, personal and family secrets, and limited data security is one of the expected results
of this program. This gives grounds to assert that in the context of the development of the
information society, the state's attention to the sphere of information rights of the individual is
increasing. The project ”information security policy" is separated into a separate subprogram. Its
purpose is to prevent threats arising in the information society, and the intended result is to ensure
human rights and fundamental freedoms, including the right to access information. Thus, the issues
of information security become very relevant in connection with the development of the
information society and arouse scientific interest among researchers, as well as are reflected in
various government documents.
Information security is understood as "the state of protection of the individual, society and
the state from internal and external information threats that ensure the realization of constitutional
rights and freedoms of man and citizen, proper quality and standards, ensuring life for citizens,
sovereignty, territorial integrity and sustainable socio-economic development, defense and security
of the state." For a more precise definition of the subject area of the concept of "information
security", it is necessary to understand the legal essence of the category "Security" as a whole. The
theory of law establishes that legal terms should have a clear meaning, as well as differ in semantic
unambiguity and functional stability. Clarity of legal norms, their uniform semantic perception and
application are important factors determining the real place and role of law in human life, society
and the state. For example: already in Ancient Rome, a lawyer needed a deep understanding of legal
vocabulary, an example is "ignoratis terminis Artis ignorerature et Ars" ("although the terminology
of the subject was unknown, the subject itself was also unknown")[8. B. 40.].
The problem of security manifested itself in ancient times as a specific social phenomenon,
which intensified and expanded with an increase in the number of threats and dangers to the
population (both from internal and external enemies). Security issues Plato, Aristotle, J.Locke, T.
Hobbes, J.J.It is considered in the works of Rousseau and other scientists. However, at present,
ensuring security is one of the most important tasks and functions of the state, society and the
individual and remains an important area of research.
Our national scientist R. N. Kurshatov pointed out the basics of the theory of information
security: these are "information security" and "information protection". Their essence ultimately
determines the policy and activities in the field of information protection. Information security is a
state of protection of dying information resources (information environment) from internal and
external threats that can harm the interests of a person, society, state (national interests) [9]. 188 p.].
So, G. V. Ivashchenko concludes: "security is not a state of protecting the interests of the
subject, security is nobody's state. Security is the conditions for the existence of an entity controlled
by it”[10.]- he pointed out. M.Y.A. Zelenkov-criticizes the approach under consideration and
emphasizes that “security through the concept of “protection” does not cover all dangerous
situations. In this regard, it should be noted that safety as a state of protection implies maintaining a
certain balance between the negative impact on the object of the environment and the ability to
overcome this impact with their own resources or appropriate means. Bodies or mechanisms should
be specially created for this purpose” [11. B. 11.].
