The National Drug Prevention Office initiated to develop a new General Convention before the
56th session of the UN General Assemby. At the same time in this regard the Head of the National
Drug Prevention Unit sent official letters to Mr. Ilham Aliyev, President of the Republic of Azerbai-
jan, Mr. Ban Ki-Moon, UN General Secretary and Mr. Yuri Fedotov, Executive Director of UNODC.
We think that today there is a need to adopt a more comprehensive UN General Convention
integrating rules, contained in the previous Conventions on drugs and often reduplicating each
other.It would contribute to implementation of international rules on drugs in national legislation.
It is advisable especially to provide for two lists of offences related with drugs and psychotropic
substances in this Convention: maxsimum and minimum lists. All offences known from the previ-
ous conventions and international criminal law would be included into the first list, but the second
one would integrate the most dangerous ones of them. Countries, which would have joined to the
proposed convention, should add the last list to the internal criminal legislation
At the same time it would be useful to unify terminology in this Convention for full and relevant im-
plementation of rules on crime types in the national legislation. The proposed Convention would
improve efficiency of international relations on crimes related with drugs and psychotropic sub-
stances, as well as interstate cooperation of law enforcement agencies for detection of crimes
committed by the same person or group. It would also serve for improvement of methods in fight-
ing against organized crime related with drugs,
The proposed Convention should also contain legal parameters of international non-governmen-
tal organizations, public movements and associations (international associations, congresses,
conferences, medical associations, experts, scientists, youth, parents etc.) which have already
become strong antidrugs force in this field. The existing Conventions do not contain any rules on
their status, legal relations with states party to these Conventions. Up to date there is no inter-
national legal framework for antidrugs activities of non-governmental organizations and public
associations, provision for scientific research done by them, their training activities on education
of new generation in life styles without drugs and all these issues are still beyond the legal frame-
work. It is extremely important to put a base for international and interstate support of activities
done by these organizations, their “legalization” and thereby give a new impulse to involvement
of more world community in this antidrugs actitivities.
Therefore it is advisable to include legal basis into national legislations for expansion of involve-
ment of international non-governmental organizations and public organizations in fighting against
drugs and its prevention.
In this new Convention, it is also important to take into account responsibilities of national
governments in prevention of promotion of drugs virtually in world computer nerworks, electronic
mass media. Today any teenager can learn about making of narcotic and psychotropic substanc-

es, ways of their use, places of sale and prices in some big cities of the world through Internet
expending only several minutes for that. From the late last century till today we have been observ-
ing growth tendency in drug related virtual data.
The new proposed Convention, based on contemporary scientific research, analytical studies,
actions taken qlobally by the states in international and national legislation and world experience,
would be helpful in addressing many issues potentially to be faced in this field in future.
In development of the new proposed Convention, it is extremely important to take into account
lessons and skills obtained as a result of reforms done by the world countries in antidrugs actions,
proposals made by specialists in legal issues as well as advanced experience and news.
NATIONAL POLICY
One of the national priorities of the Government of Azerbaijan is to enhance anti-drug legislative
framework and adjust it in line with current changes and requirements. Primary objective of legal
and regulatory acts adopted in this area to cover ongoing changes in social, economic, legal and
other aspects of trafficking in narcotic drugs.
In 2005 some changes have been made in laws regulating trafficking in narcotic drugs, social
and legal activities related hereto as well as effects of such activities. From this prospective the
principal change included enactment on June 28, 2005 of the new Law on «Trafficking in Narcotic
Drugs, Psychotropic Substances and Its Precursors» that abolished previous Law «Against Illicit
Trafficking in Narcotic Drugs, Psychotropic Substances and Its Precursors» adopted on June 18,
1999. A new Law embodies general improvements as well as amendments and modifications
made to a number of articles of the previous one.
In general a number of legal acts have been adopted in this area before. In its turn enactment
of the new law on narcotic drugs necessitated making proper adjustments in those legal acts
adopted in this area previously. Proceeding from adoption of the new Law in 2005, President of
Azerbaijan assigned the Cabinet of Ministers to ensure bringing current legal acts on narcotic
drugs in line with the Law mentioned above.

LEGISLATIVE FRAMEwORK
One of the main issues, which the contemporary society has encountered today, is the spreading
of drug addiction. This issue, which troubles most countries and nations, has taken global and
general features.
One of the factors, needed for successful actions taken against drug addiction, is the existence
of legal basis fitting international standards in each national legisation and the legal basis should
meet contemporary demand reflecting effective actions.
From this point of view, improvement of legislation base governing legal issues in antidrugs ac-
tions on the territory of the Republic of Azerbaijan, bringing them into concord with changing en-
vironment and demands are the main action directions of the government and state. The adopted
laws and normative acts aim at inclusion of changes in social, economic, legal relations on drug
trafficking.
The National Law on «Trafficking in Narcotic Drugs, Psycothropic Substance and Its Precursors»
adopted on June 28, 2005 is different from previous one by a number of indicators. It regulates not
only issues on illicit trafficking in narcotic drugs, psychotropic substances and its precursors but
all social aspects related to traffcking in narcotic drugs, psychotropic substances and its precur-
sors in general and specifies rights and duties of individuals and legal entities concerned.
The Law consists of 6 Chapters and 33 Articles. While providing definitions in Article 1 of the
Chapter 1 (general provisions) of this Law reference has been made to the UN Single Conven-
tion on Narcotic Drugs of 1961, Convention on Psychotropic Substances of 1971 and Convention
Against Illicit Trafficking in Narcotic Drugs and Psychotropic Substances of 1988.
Treatment of drug addicted persons in Azerbaijan is regulated in line with the Law on Narcological
Service and Control signed by President on June 29, 2002. This Law is a basic legal document
for prevention of drug addiction, medical checkup, treatment and rehabilitation of drug addicts.
Some legislative acts were amended in the light of implementation of Law on Trafficking of Nar-
cotic Drugs, Psychotropic Substances and their Precursors by the Decree of the President of the
Republic of Azerbaijan on 21 June 2007.
At the same time it is worthy to mention that within actions taken by the Ministry of Justice on im-
provement of legislation, with the view of execution of Presidential Decree, dated by 25.04.2012,
on implementation of Law, dated by 07.03.2012, on amending the Law on Narcological Service
and Control, they took some actions on bringing the effective legislative acts in concord with this
act and it was reported to the Cabinet of Ministers by letter sent on 21.06.2012.
Drafts of Rules on Narcological Aid at the Expense of State Budget (on 14.06.2012) and Intruc-
tions on sending and receiving data into and from nationwide data bank on import, export, transit
transportation and making of narcotic drugs, psychtropic suabstances and their precursors as

well as on persons involved in illegal trafficking of narcotic drugs and psychotropic suabtsances,
including those who suffer from drug addiction (on11.11.2012) were considered and opinion was
expressed on them.
In this regard, the opinion expressed by the Ministry on World Drugs Report for 2012 developed
by the United Nations Office on Drugs and Crime was transmitted to the Ministry of Foreign Affairs
on 05,04,2012.
NATIONAL STRATEGY AND INSTITUTIONAL FRAME-
wORK
The National Program on «Control Trafficking in Narcotic Drugs, Psychotropic Substances and Its
Precursors and Prevention of Drug Addiction» approved by the Presidential Decree #2271 dated
of June 28, 2007 constitutes national policy of combatting illicit trafficking in narcotic drugs.
Main objectives of the third National Program for 2007-2012 are to enhance combatting illicit trafficking in
narcotic drugs, psychotropic substances and its precursors as well as prevention of drug addiction; to pre-
vent illicit trafficking in drugs and drug addiction via anti-drug advocacy, awareness raising, rehabilitation
and treatment of drug addicts; to improve medical and rehabilitation activities; to improve relevant laws;
to conduct scientific researches and practical studies with a view of learning efficiency of punishments ap-
plicable for relevant offences; to deepen international cooperation. At present the draft National Proqram
for 2013 – 2018 has been developed on the basis of opinions expressed by all public authorities and it is
close to be signed.
The State Drug Control Commission established under the Presidential Decree #488 dated of Au-
gust 26, 1996 is authorised to oversight implementation of the National Program where the Min-
istry of Internal Affiars, Ministry of National Security, Ministry of Health, Ministry of Justice, State
Customs Committee, State Border Service, Ministry of Information and Communication Technolo-
gies, Cabinet of Ministers, Ministry of Agriculture, Ministry of Ecology and Natural Resources are
specified as implementing agencies.
The Task Force is functioning within the State Drug Control Commission. It was set up to ensure
and coordinate implementation of the State Drug Control Commission’s activities as well as to
oversight implementation of the National Program on «Control Trafficking in Narcotic Drugs, Psy-
chotropic Substances and Its Precursors and Prevention of Drug Addiction» for 2007-2012.
Composition of the State Drug Control Commission has been changed and its new structure ap-
proved by the Presidential Decree #429 dated of August 6, 2009. Now the State Drug Control
Commission is chaired by the Deputy Prime Minister and consists of officials of the:

Another special institutional structure is the National Database established according to the Cabi-
net of Ministers Decision #71 dated of April 17, 2000 within the Central Drug Enforcement De-
partment of the Ministry of Internal Affairs. Drugs related information from the 8 state agencies is
compiled and processed by this Database.
The National Law on «Trafficking in Narcotic Drugs, Psychotropic Substances and Its Precur-
sors» adopted in 2005 lays the legal foundation for carrying out anti-drug activities and establish-
ing new institutional structues for collection, processing and exchange of data on narcotic drugs.
Article 9 of this Law provides setting up National Narcotic Drugs Information Center. The Law sets
out rights and duties of this Center. According to the Law ultimate goal of the National Narcotic
Drugs Information Center is to arrange compiling non-private and objective data on trafficking in
narcotic drugs and psychotropic substances (Article 9.2). The Law classifies types of data to be
collected by the National Narcotic Drugs Information Center:
• Data on non-medical and medical use of narcotic drugs and psychotropic substances as well
as on medical, economic and other implications of such use;
• Data on illicit trafficking of narcotic drugs and psychotropic substances and its consequences;
• Data on medical and non-medical demand in narcotic drugs and psychotropic substances;
• Data on harms of narcotic drugs and psychotropic substances for individuals and communi-
ties as well as on measures aimed at reducing its non-medical supply;
• Non-private information on treatment and rehabilitation of drug addicts;

• Data on activities implemented by NGOs to fight against trafficking in narcotic drugs and psy-
chotropic substances;
• Data on outcomes of narcological studies on narcotic drugs and psychotropic substances as
well as on assessment of current narcological situation in the country;
• Data on state policy, legal and regulatory matters on narcotic drugs.
Analysis of the anti-drug addiction policy aimed at identifying most alarming criteria in negative
trends, dynamics and structure of illicit trafficking in narcotic drugs demonstrate strong adherence
of Government to policy and approach of combatting this pattern of crime. The national policy in
this area represents strategic system supported by state agencies and focused on detection and
prevention cases of illicit trafficking in narcotic drugs and its precursors, prevention of use of non-
medical narcotic drugs, treatment and rehabilitation of drug addicts.
In general, strategic directions of the state policy against illicit trafficking in narcotic drugs and
drug addiction have been identified, while organizational, legal, institutional and practical meas-
ures are being cuurently implemented. The legal and regulatory framework governing activities
against illicit trafficking in narcotic drugs, psychothropic substances and drug addiction is en-
hanced and adjusted in conformity with international standards, meanwhile country involvement
in international anti-drug innitiatives more intensified.
PREVENTIVE MEASURES
There is a system of actions taken by various public and non-governmental agencies to prevent
use of drugs in our country. Each agency takes actions stipulated by their annual plan of actions.
The plans of actions focus on in-school actions and projects. People, especially youth covered by
these actions do not exceed 17%.
The Ministry and agencies mainly use traditional methods contained in the National Program for
building actions on reduction of demand for drugs. The used new approaches are not of meth-
odological importance. Various innovations are used only in development and use of awareness-
raising projects.
One of the top and pressing issues of present days includes advocating healthy lifestyle among
population, especially young people as recent trends in tobacco, alcohol and narcotic drugs use
among minors and youth are rising. In addition number of related offences committed by young
people are reportedly increasing. Various social, economic and psychological reasons enable
such a «growth». Advertising tobacco, alcohol and even narcotic drugs by various methods and
ways, lack of knowledge on this matter among young people, negative impacts of vicious social
factors and other reasons contribute to worsening of the problem.

These reasons form various patterns of stereotype of wrong thinking and misconduct among
minors and young people. According to these patterns of stereotype tobacco smoking, alcohol
drinking and even using of narcotic drugs together with free sex are being perceived by young
generation as usual and ultra modern habits. Another threat is that using alcohol, tobacco and
narcotic drugs as well as starting early sexual life is misapprehended by young people as signs
of making first steps in the adult life and getting free hand. All these facts were repeatedly proven
by recent sociological and socio-psychological studies.
Sophisticated advocacy mechanisms and well-weighed are very much needed to ruin such un-
healthy lifestyle, stereotypes of wrong thinking and misconduct and to foster culture of healthy
way of life. Otherwise the measures undertaken so far will not be sufficiently effective.
In addition to the advocacy related activities carried out by the state agencies in 2012 under their
current action plans, various projects were implemented by NGOs. Events and surveys held by
the Minstry of Youth and Sport, one of the agencies responsible for general advocacy work, look
more active against a background of other preventive measures. The surveys conducted have
enabled to find out current gaps and shortcomings in the advocacy activities as well as to develop
certain proposals in this context.
GENERAL PREVENTION
Taking into consideration the current situation on drug addiction in near-border areas of the coun-
try scope of activities against drug addiction, on anti-drug advocacy, training and awareness
raising have been expanded. For this reason the Ministry of Youth and Sport in cooperation with
the Ministry of Education has designed and implemented relevant action plan. Following this plan
thematic contests, meetings and conferences were held for students and pupils.
Within the activities planned by the Ministry of Youth and Sport for 2011, events have been organ-
ized to cover 3 main directions:
1. Mass events and actions with involvement of young people.
2. Workshops, meetings and educational events with participation of young people.
3. Trainings and consultations for the Ministry’s officials.
In order to provide direct inclusion and interactivity of young people in advocacy activities the
Power Point CD on harm of narcotic drugs, alcohol and tobacco has been presented. Workshops
under common slogan «No to Bad Habits» were held in Ganja, Gobustan as well as in Salyan
region. During these workshops various presentations have been made, relevant handouts dis-
seminated and short film on AIDS demonstrated to participants.
The Ministry of Youth and Sport organized music festival where students from 150 secondary and

high schools had taken part. During this festival its presenters, participants, famous guest sing-
ers have sent various messages against drug addiction. This event was widely broadcasted and
attracted big audience.
In addition the Ministry of Youth and Sport, National Council of Youth Organizations and UNICEF
organized the special summer school project «Think, Live and Be Healthy» in the Guba region.
120 young persons from 25 regions of the country participated in this project. The main goal of
this school was to advocate healthy way of life, foster lidership skills and prevent various bad
habits among young people. In 2012 special social activities under the slogan «Young People
Join Against Bad Habits» were conducted by the Ministry of Youth and Sport in Lankaran, Astara,
Yardimli, Masalli, Neftchala, Salyan, Bilasuvar and Jalilabad regions of the country. In general
these activities have covered about 1,800 minors and young persons.
The Ministry of Education implements through funding and administrative support of various
international humanitarin organizations large-scale events explaining advantages of healthy life-
style to children and young people. Special manuals and curriculums have been designed and
special courses delivered in secondary schools and non-school facilities in close cooperation with
organizations mentioned above. The optional subject «Life Habits Learning» is taught several
years one hour per week for the 1-11 forms of secondary schools with support of UN Global Fund
and UNICEF. The manual for each form contains various topics on threat of drug addiction, on
healthy lifestyle, bad habits etc.
Moreover the Ministry of Ecology and Natural Resources, within its mandate, carried out a num-
ber of events in the country regions. These events included preventive and awareness raising
activities. Within the National Program on «Control Trafficking in Narcotic Drugs, Psychotropic
Substances and their Precursors and Spread of Drug Addiction» for 2007-2012 and with a view
of undertaking comprehensive preventive measures in the country regions throughout 2011, the
relevant divisions of this Ministry with participation of representatives of the local urban and rural
administrations, municipalities and communities have arranged advocacy meetings and held gen-
eral consultations against drug addiction and illicit trafficking in narcotic drugs and its precursors.
According to the Ministry of Ecology and Natural Resources regular monitoring and spot-checks
as well as advocacy and awareness raising meetings and round tables are held in regions of the
country by relevant structures of the Ministry with participation of local administrations, municipali-
ties and population in order to prevent cultivation of drug contained plants in forestries and special
preserved areas.
In order to enhance measures aimed at destruction of drug contained, wild growing and illegally
cultivated plants the Ministry of Agriculture through its local specialists in territorial departments
in Lankaran, Ujar, Shaki, Guba, Shamakhi and Barda covering various regions of the country or-
ganize on regular basis awareness raising campaigns among general population, students and
