in public places, hold meetings with land owners and inform local population about wild growing
drug contained plants and its natural habitat areas in Azerbaijan. The Scientific and Research In-
stitute on Forage, Meadows and Pastures provides local specialasists with instructive information
on cultivated and wild growig varieties of drug contained plants such as cannabis and hashish,
their vegetation periods, shape of seeds and with other relevant data with a view of designing
of map on areas of growing drug contained plants, preventing its spread and conducting related
scientifica and research activities.
TREATMENT OF DRUG ADDICTS AND AVAILABLE
TREATMENT SYSTEM
Treatment of drug addicted persons in Azerbaijan is regulated in line with the Law on Narcological
Service and Control signed by President on June 29, 2002. This Law is a basic legal document
for prevention of drug addiction, medical checkup, treatment and rehabilitation of drug addicts.
Under this Law the Government ensures providing narcological service to every person suffer-
ing from drug addiction. Treatment of narcologically sick persons in Azerbaijan is carried out in
specialized medical facilities only by narcologists, psychiatrists, psychologists. In addition medi-
cal departments attached to the penitentiaries are allowed as an exception to provide such kind
of treatment. Besides the public medical facilities mentioned above there are not private clinics
licensed by the Ministry of Health to treat drug addicts in Azerbaijan. Any private medical practice
on drug addiction or its treatment is prohibitied by law.
There is a number of specialized medical facilities treating drug addiction in the country. Moreover
too many public hospitals and clinics have special anonymous narcological consulting wards.
Usually in Azerbaijan treatment is provided to drug addicts on voluntary basis. A person under
18 is referred to the narcological medical facility with the consent of his/her parents or legal rep-
resentatives. Involuntary medical treatment or chek-up of narcologically sick persons is possible
only under relevant court decision issued in conformity with national appplicable laws. Drug ad-
dicts are registered by the Narcological Service. There are two main registers in the country:
Dispensary registered drug addicts who undergo either in-patient or out-patient treatment; and
Prophylactically registered drug users, i.e. occasional drug users who underwent full medical
treatment and according to applicable laws will undergo periodic treatment courses during next
5 years.
In line with relevant laws a person who underwent complete treatment course will be listed in
prophylactic register during 5 years and undergo periodical medical checkups in the specialized
medical facilities. If during 5-years period a next case of drug use by the person concerned is not
reported he/she will be deleted from the prophylactic list.
Within actions taken by the Ministry of Justice on improvement of legislation, with the view of

execution of Presidential Decree, dated by 25.04.2012, on implementation of Law, dated by
07.03.2012, on amending the Law on Narcological Service and Control, they took some actions
on bringing the effective legislative acts in concord with this act and it was reported to the Cabinet
of Ministers by letter sent on 21.06.2012.
CURRENTLY RECORDED DRUG ADDICTS
According to official data given by the Republican Narcological Center of the Ministry of Health of
the Republic of Azerbaijan, in 2012 1878 people were newly recorded by the republican narco-
logical service as drug users, 1374 of them are registrated in the dispensary and 504 in preven-
tive records. (in 2011 the number of recorded people was 1999 – 1566 in dispensary and 433 in
preventive records).
In 2012 the total number of drug dependent people recorded by the Republican Narcological
Service was 27910. 21999 of them were registrated in the dispensary, 5911 in preventive records
(in 2011 26717 people were recorded – 20861 in the dispensary and 5601 in preventive records).
The number of those which are registrated in anonymous records is 567 (in 2011 it was 254).
528 out of recorded drug dependent people are females. 362 of them are registrated in the dis-
pensary and 166 in preventive records (in 2011 the number of such women was 511 – 350 of them
were registrated in the dispensary and 161 in the preventive records).
Concerning division for age groups, those aged 14 – 17 among the total number of recorded drug
dependent people were 4 people with 2 in the dispensary and 2 in the preventive records (in 2011
they were 2 people), those aged 18 – 29 were 5010 people with 3699 in the dispensary and 1311
in the preventive records (in 2011 they were 4979 people – 3499 in the dispensary and 1480 in
the preventive records), those aged 30 – 39 were 8134 people with 6094 in the dispensary and
2040 in the preventive records (in 2011 they were 8304 people – 6218 in the dispensary and 2086
in the preventive records), those aged 40 – 59 are 11088 people with 8698 in the dispensary and
1593 in the preventive records (in 2011 they were 13175 people – 11143 in the dispensary and
2032 in the preventive records), those aged 60 – 65 and above were 3674 people with 3506 in
the dispensary and 168 in the preventive records.
In 2012 the total numbe of those removed from the records by the Republican Narcological Cent-
er was 430 – 236 of them were removed from the dispensary and 194 from the preventive records
(in 2011 408 people were removed from the records – 253 from the dispensary and 155 from the
preventive records). As it is seen from statistics, the number of drug dependent people increases
year by year.
One of the outstanding achievements in the treatment of drug addiction in our country is availi-
bility of substitution therapy used among injection drug users in many foreign countries. Unlike

many foreign countries, this program is conducted by the state line. For this end, in accordance
with Rules and conditions on use of narcotic drugs and psychotropic substances for medical pur-
poses, as well as rules on use of medical actions for drug dependent people, approved by the
decision nr.165, dated 11 September 2000, issued by the Cabinet of Ministers of the Republic
of Azerbaijan, since 2004 methadone substitution program has been being carried out by the
Republic Narcological Dispensary through use of synthetic opium preparations, allowed only for
those, which use narcotic drugs from intravenous and opium group drugs for non-medical pur-
poses, and produced by the medical industry. The Ministry of Health of the Republic of Azerbaijan
issued the order nr.83, dated by 14.08.2001 on implementation of this program by the Republican
Narcological Center.
“Terms and rules on implementation of substitution therapy used for treatment of drug dependent
people” was approved by the decision nr.021, dated 26.01.2006, issued by the Cabinet of Minis-
ters of the Republic of Azerbaijan. It should be noted that basic principles for use of substitution
treatment programs directed towards prevention of spreading HIV / AIDS among injection drug
users.
At present two points are operational on methadone substitution program – the Republican Nar-
cological Center and AIDS Center. Now 88 people (in 2011 they were 107) are involved in this
program by the Republican Narcological Dispensary and 45 people by the AIDS Center (in 2011
they were 44).
Over 2012 out of program attendees 6 people died, 6 were arrested, 8 were detoxicated, 9 left it
for unknown reasons
The HIV related voluntary consultation and testing point at the Republican Drugs Center, created
by virtue of order nr.22\I-SH, dated by 16.07.2011, issued by the Ministry of Health of the Republic
of Azerbaijan, is operational since 14.07.2011. Since 2012 1642 people have been tested. 64 of
them were HIV-positive.
Besides this, in 2012 forensic narcological medical examination of those, sent to the Republic
Narcological Center of the Ministry of Health of the Republic of Azerbaijan by the Ministry of
Justice was provided, Totally 1901 people were examined. 1411 of them were examined for the
first time, but 490 were repeatedly examined ones (in 2011 2092 people were examined – 1484
first time examined and 608 repeatedly examined ones). Out of examined people, the number
of those, which are in need of compulsory treatment is 1239, but those, which are not in such
a need, are 254 people (in 2011 those in need of compulsory treatment were 1441 people, but
those, which are not in such a need, were 285).

DRUG RELATED CRIMES
As the drug addiction is extremely complicated public danger, amount of damage caused by it can
not determined by single measurement. It means also degradation of drug addicts, pushing them
to commit crimes, falling of material and technical and intellectual potential of the society, gene
pool worsening, increase and expansion of criminal organizations and drug mafia.
This section of the Report includes assessment of current situation on illicit trafficking in narcotic
drugs in the country. The main source of information used in this section is data provided by Task
Force under the State Drug Control Commission, Central Drug Enforcement Department of the
Ministry of Internal Affairs, Ministry of National Security, General Prosecutors Office, State Cus-
toms Committee, Ministry of Justice and State Border Service.
The core statistics for last 2 years have been used in order to assess the situation on illicit traffick-
ing in narcotic drugs. Assessment of statistics on illicit trafficking in narcotic drugs for last 2 years
(2011-2012) show the general trends of dropping some figures. Amounts of seized narcotic drugs
could be shown as an example.
In 2012 various types of narcotic drugs and psychotropic substances in total quantity of 1 t. 371
kg.008,999 gr. were taken out of illegal trafficking by the law enforcement agencies. Out of them
hashish - 638 kg.456, 465 gr.; heroin – 109 kg. 756,053 gr.; opium – 240 kg. 421,039 gr.; mari-
juana – 312 kg. 462,732 gr.; cocaine – 120,432 gr.; methadone – 89,42 gr.; methamphetamine
– 12 kg. 615,1 gr.; pills – 7 kg. 518 gr. and other narcotic drugs – 49 kg. 520,302 gr. were taken.
Every year the law enforcement agencies of Azerbaijan carry out large-scale operations on detec-
tion and destroying wild drug contained plants. in 2012 as a result of these operations poppy in
total amount of 336 t. 480 kg. was detected and destroyed by the law enforcement agencies (in
2011 336 t. 777kg. 301 gr.).
Favorable climatic conditions of the country allow cultivating poppy and cannabis of various
growths; in its turn it worsens the drug related situation in the country and may be used as a
ground for establishment of «the raw source» for illicit trafficking in narcotic drugs.
In 2012 totally 2590 crime facts related with drug trafficking were detected by the law enforcement
agencies (in 2011 2921 fact).
As in previous years, these facts mainly relate to illegal keeping, sale and cultivation of drugs.
In 2012 more than half of recorded drug related crimes, i.e. 1660 facts relate to illegal keeping of
narcotic drugs and psychotropic substances (in 2011 1762 facts); 780 facts relate to illegal sale of
narcotic drugs and psychotropic substances (in 2011 917 facts); 136 facts relate to illegal cultivation
( in 2011 111 facts); and 14 facts relate to other drug related crimes (in 2011 10 facts).

According to official data given my the Penitentiary Service of the Ministry of Justice of the Repub-
lic of Azerbaijan, in 2012 totally 90 crime facts related with drugs were detected in prisons under
the Penitentiary Service. 50 of them were detected in protected esatablishments, 40 in open-type
establishments (station type places) (in 2011 108 crime facts were detected – out of them 54 in
closed-type establishments and 48 in open-type establishments; and 6 fact in special establish-
ments).
Over that period 30 cases of taking drugs into the protected establishments by citizens and 3
cases of taking them by staff members were prevented. Narcotic drugs in total amount of 447,721
gr. (out of them heroin – 137,48 gr.; opium – 143,994 gr.; marijuana – 108,507 gr.; hashish – 57,74
gr.) were taken in these establishments. (in 2011 heroin – 241,947 gr.; marijuana – 46,697 gr.;
opium – 23,184 gr.; hashish -18,682 gr.; psychotropic substances – 1,819 gr. were taken out of
the illegal trafficking).
In 2012 1617 prison inmates were involved in compulsory treatment at the Treatment and Spe-
cialized Treatment Establishments of the Penitentiary Service on the basis of court decisions in
accordance with article 93 of the Criminal Code of the Republic of Azerbaijan. Medical opinions
were issued on 1452 drug dependent prison inmates, which were not in need of compulsory treat-
ment anymore.

Over this period “health care rooms” were created in medical-sanitary units of 2 more establish-
ments and their number reached 4. Prison inmates, infected with HIV / AIDS and those suffer-
ing from drug addiction and other diseases receive psychological assistance there. In 2012 393
prison inmates received this assistance.
In 2012 totally 5630 people were sentenced for illegal trafficking of narcotic drugs and psycho-
tropic substances. 3243 of them were sent to receive compulsory treatment (in 2011 they were
5785 people, 3289 of them were sent to receive compulsory treatment).
According to the State Customs Committee 87 crime facts related with illegal trafficking of drugs
were recorded in 2012 (In 2011 138 crim facts). On the facts narcotic drugs in total amount of 136
kg.876 were taken from the illegal trafficking. Out of them opium – 10 kg.540,5 gr.; marijuana – 102,
17 gr.; hashish – 107 kg. 513 gr.; heroin – 3kg. 869,34 gr.; cocaine – 0,216 gr.; methadone – 9,42
gr.; methamphetamine – 12 kg. 613,6 gr.; phenabarbital – 2 kg. 150 gr.; diazepam – 76,1 gr.; al-
prazolam – 0,35 gr.; klonazepam – 0,552 gr.; dihydromorphine – 0,1 gr. (in 2011 narcotic drugs in
amount of 227 kg. 565 gr. were taken. Out of them cocaine – 100,130 gr.; marijuana – 52,18 gr.;
methamphetamine – 6kg. 875 gr. and other narcotic drugs).
Totally 110 people (103 males and 7 females) were held criminally liable on this facts. Out of them
78 were Azerbaijani nationals, 32 foreign nationals. (in 2011 133 males and 21 females, so totally
154 were held criminally liable for such crimes).
According to data received from the General Public Prosecutor’s Office of the Republic of Azerbai-
jan, 6 criminal cases were investigated, 1 case was cancelled, 1 case was suspended and 4 cases
on 7 people were sent for the court consideration.
In 2012 as a result of complex measures taken by the State Border Service, narcotic drugs totally
in amount of 251 kg.233 gr. (heroin – 26,132 kg.; opium – 102,712 kg.; hashish – 108,217 kg.;
marijuana – 6,604 kg.; cocaine – 0,216 kg.; pills – 7,518 kg.) on 92 facts were taken. Out of them
204 kg.999 gr.were taken at the green border in 21 cases, 33 kg.234 gr. as a result of joint opera-
tions held with custom officers at border control points in 69 cases and 13 kg. at the sea border
in 2 cases.
DRUG SEIZURES
The Central Drug Enforcement Department reports about several groups of narcotic drugs, psy-
chotropic substances and precursors seized by various law enforcement agencies in 2012. They
are mainly cannabioids and opiates. Hashish and marijuana are among cannabioids. Lesser part
of cannabioids like marijuana is cultivated in Azerbaijan. Other narcotic drugs and psychotropic
substances, including strong ones are trafficked to local market from either neighbouring coun-
tries or Afghanistan via those neighbouring countries, e.g. opiates, heroin.

In 2012 totally 2636 crime facts were detected as a result of search operational and preventive
measures taken against illegal trafficking of narcotic drugs, psychotropic substances and their
precursors. Out of them 817 cases relate to illegal sale of drugs, 1694 relate to illegal keeping,
111 relate to illegal cultivation and 10 relate to other drug related crimes.
AVAILABLE AND TRAFFICKED DRUGS
Availability of nine climate zones in Azerbaijan allows cultivation of most narcotic plants here.
Besides this the dynamic development of Azerbaijan attracts attention of organized groups which
intend to use this territory as a transit region for new drug trafficking routes.
Climatic conditions of the country allow cultivating here drug contained plants. Moreover forest
belts, mountain sides, valleys and other sites available in the country promote to wild growth of
drug contained plants. As it Is mentioned above, every year the relevant law enforcement agen-
cies hold special operation called “Hash-hash” in order to find out and destroy such plants.
According to the Main Drug Enforcement Department of the Ministry of Internal Affairs of the Re-
public of Azerbaijan, in 2012 as a result of operational measures, narcotic plants in total amount
of 336 t.480 kg. were taken and destroyed by the law enforcement agencies (in 2011 366 t.)
Most of narcotic drugs sold at black market of the country are trafficked from neighbouring coun-
tries. They are mainly opiates such as heroin and opium as well as amphetamins, psychotropic
substances and cocaine. Cannabioids such as marijuana and hashish are cultivated in the coun-
try mainly for personal use or for sale in small lots at black market. In most cases it is not commit-
ted in organized manner but by various individuals. Therefore the most important problem relates
to narcotic drugs trafficked illicitly from abroad. This problem is primarily caused by strategic loca-
tion of the country at the tranzit route between East and West. Azerbaijan located at Europe-Asia
transport route borders with Russia, Iran and Georgia and it lays «favourable» ground for illicit
trafficking in narcotic drugs from Central Asian countries to West and Central European states as
well as to central regions of Russia. Therefore it is inevitable that some part of narcotic drugs traf-
ficked illicitly via international borders of Azerbaijan remains in the country and affects on annual
rise in number of its users.
In 2012 totally 24 foreign nationals were held criminally liable and various types of narcotic drugs
in total amount of more than 200 kg. were taken from them. Out of them Iranian nationals - 44,
Russian nationals - 13, Georgian nationals - 13, Afghan nationals - 7 and Slovakian nationals - 1.
The data indicated above is considered as basic one for assessment of situation on illicit traffick-
ing in narcotic drugs in the country and may lay a groundwork for designing forthcoming strategic
steps aimed at preventing drug related offences in future.

EXAMINATION OF NARCOTIC DRUGS
In accordance with operational directions, the Forensic Examination Center of the Ministry of Jus-
tice of the Republic of Azerbaijan does preliminary research and examinations of narcotic drugs,
psychotropic substances and their precursors, renders scientific methodological assistance to
judicial and law enforcement agencies in appointment, conduct of examinations and assessment
of expert opinions, studies causes and conditions of committment of such crimes, does crimi-
nological research for prevention of them and takes legal educational measures on anti-drugs
promotion.
The recent achievements of scientific and technical progress are more often applied in the ex-
amination process. For this reason advanced international experience is learned and up-to-date
equipment produced by the advanced countries is purchased to increase physical and technical
resources of the Forensic Medicine Center. Introduction of recent technologies in this area is ef-
fectively used for narcotic drugs examination.
According to official data received from the Forensic Examination Center of the Ministry of Justice
of the Republic of Azerbaijan, 3440 examinations were made on narcotic drugs, psychotropic
substances and their precursors in 2012 (they were 3862 in 2011). Please find below their types,

At the same time 11 examinations on narcotic drugs, psychotropic subtances and their precursors
were made by Nakhichevan branch of the Center .
In 2012 scientific-research was made on topic of “Scientific methodological and procedural prin-
ciples of forensic examination of narcotic drugs, psychotropic substances and their precursors” at
the Forensic Examination Center. As a result of this research, technical tools and methodological
principles of preliminary examination of narcotic drugs, psychotropic substances and their precur-
sors were considered and most efficient methods were established.
