According to the "Miranda rule", it is explained to the person from the first minutes that the 
detained person has the right to remain silent, to demand the participation of the defense counsel in 
the interrogation process, and so on. That is, the Constitution shows almost all the ways to protect 
criminal fugitives from the control of state agencies and officials. The "Rule of Miranda" included 
in the Constitution, which stipulates that a person should be informed about his rights at the 
moment of his arrest, and if he is detained by a law enforcement officer, he should receive a 
satisfactory answer to the question of whether his rights were explained to the detained person. used 
in democracies. 
Among other things, the Constitution stipulates that "A person cannot be detained for more 
than forty-eight hours without a court decision. Enshrining this norm at the constitutional level is a 
firm guarantee of a person's right to free movement, and that a person must be brought to court to 
resolve the question of the legality and reasonableness of the detention before forty-eight hours 
from the time of detention. strictly determines that if the court does not make a decision related to 
the detention of a person or other type of restriction of his free will, the person must be released 
immediately. 
According to Article 28 of the updated Constitution, "No one is obliged to testify against 
himself or his close relatives." The question arose by itself, what does the fact that a person is not

In particular, Article 116 of the Code of Criminal Procedure stipulates the freedom of a 
person to give contrary instructions to his relatives, and close relatives of the suspect, the accused, 
the defendant can be questioned as witnesses or victims only with their consent. possible. [5., ] 
This standard means that before interrogation by the court and law enforcement teams, the 
person must be informed of his or her immediate family's right not to be contradicted. The right not 
to incriminate oneself is not limited to the prohibition against coercing a confession to a crime. This 
standard serves to prevent the use of moral pressure, all kinds of intimidation, insults to honor and 
dignity, and other illegal methods to any person under criminal prosecution or his relatives.
At the same time, this article introduces an important rule that "the conviction of a person 
and the resulting legal consequences cannot be the basis for restricting the rights of his relatives."
