Gegenstand des Projektes ist die Wirkung, die ausgewählte EU-Ent-

scheidungsverfahren aus dem Bereich der Binnenmarkt- regulie-

rung auf die erzeugten Entscheidungen ausüben. Unter- sucht

werden sollen die folgenden drei Fragen: (a) ob sich innerhalb der

EU Verfahren entwickelt haben, die systematisch problem- adäqua-

tere (und damit stärker gemeinwohlorientierte) Ergebnisse erzeu-

gen, als dies inVerhandlungssystemen eigentlich zu erwarten ist,

(b) aufgrund welcher Wirkme- chanismen diese Ergebnisse entste-

hen und (c) inwieweit die Bindung an fallübergreifende inhaltliche

Vorgaben dabei eine Rolle spielt. Dazu sollen die Verfahren zur Set-

zung technischer Regeln (Normung) und zur Zulas- sung von Arz-

neimitteln insbesondere darauf hin analysiert werden, an welchen

Stellen Konflikte entstehen, wie diese gelöst werden und welche Fol-

gen sich daraus für die Gemeinwohlorientierung der erzeugten Ent-

scheidun- gen ergeben.

Ausgehend von der Beobachtung, daß bestehende internationaler

Regime und Organisa-tionen über differenzierte Entscheidungspro-

zesse verfügen, an denen eine Vielzahl un-terschiedlicher Gremien

und Akteure beteiligt ist, soll untersucht werden, ob - und auf-grund

welcher sozialen Mechanismen - komplexere Entscheidungsverfah-

ren systema-tisch zu Ergebnissen führen (können), die stärker ge-

meinwohlorientiert sind, als dies von einfachen zwischenstaatlichen

Verhandlungsprozessen gemeinhin erwartet wird. Dazu werden in-

ternationale Institutionen als Entscheidungssysteme konzipiert, die

den jeweils beteiligten staatlichen und nicht-staatlichen Akteuren

Handlungschancen zuwei-sen und damit selbst Einfluß auf die in ih-

rem Rahmen erzeugten Entscheidungen ge-winnen. Das Projekt

knüpft an die Diskussionen um die Formen des Regierens jenseits

des Nationalstaates sowie um deliberative bzw. argumentative Ent-

scheidungsprozesse an.
